| dc.description | El desarrollo de la ecuación del riesgo en los seguros de Responsabilidad Civil, es el tema principal analizado a lo largo del texto en conjunto con normas, jurisprudencia y doctrina, pues concurre a su tratamiento un sinnúmero de elementos que son importantes para las compañías aseguradoras. De tal manera la investigación del tema al lado de ejercicios como el de las cláusulas delimitadoras del riesgo (claims made), la ocurrencia del siniestro, su verificación o acaecimiento, los hechos que lo causaron y la conceptualización o definición dentro de la redacción contractual, son temas que demuestran el difícil panorama al momento de definir cuál es la cobertura a prestar según el caso. Estamos ante cláusulas delimitadoras del riesgo en su ámbito temporal, o acaso ante limitativas de derechos cuando no puntualmente lesivas? Y es precisamente este tema, otro punto importante, pues los vacíos en la coberturapresentan los dilemas mas grandes dentro de las aseguradoras al momento deresponder por situaciones que no son de ocurrencia típica y que por tanto no se ha conocido aún alguna solución al respecto. | |
| dc.description | The development of the risk equation in civil liability insurance policies is themain issue studied throughout this text along with the rules, jurisprudence anddoctrine to the extent that its discussion entails a number of elements that areimportant to insurance companies. Hence, the issue researched along with risklimitation clauses, the occurrence of the loss, verification thereof, events resultingin a loss and the definition within the contractual language are topics thatshow a difficult panorama when trying to define which is the coverage to beprovided. Are we before risk limiting clauses in a temporal ambit or rather beforeharmful rights-limiting clauses? And it’s precisely this issue another veryimportant moot point because non-defined coverage aspects pose the biggestdilemmas for insurance companies at the time of covering losses that do notoccur frequently and with respect to which a solution has not yet been devised. | |
