dc.descriptionEste artículo tiene como finalidad ofrecer un panorama acerca de la complejidad que tiene dentro del mundo del derecho la interpretación y especialmente la interpretación constitucional. Respecto a esta se resaltará su importancia a la luz de la Constitución de 1991 y de la realidad nacional. Se analizarán dos sentencias de la Corte Constitucional en las cuales se plantea el “estado de cosas inconstitucional” y en las cuales la Corte realiza una interpretación antiformalista y razonable. Así mismo se mostrarán las diferencias fundamentales entre formalismo y antiformalismo, haciendo énfasis en la razonabilidad y conveniencia de ésta última postura a la hora de interpretar y aplicar el derecho.
dc.descriptionThis article is intended to offer a general background, regarding the complexity of interpretation in the legal world, specially in front of constitutional interpretation. Referring to this last aspect, it becomes crucial to specify its importance under the light of the Colombian Constitution of 1991 and the Colombian national reality. Two sentences will be analyzed in which the Colombian Constitutional Court adopts the “inconstitutional state of things” concept, and furthermore proceeds to an antiformalist and reasonable interpretation. Like so the fundamental differences between formalism and antiformalism shall be treated, emphasizing the convenience and reasonability of the latter when interpreting and applying the law.
