dc.descriptionEl artículo es avance de la investigación de tesis doctoral. Se trata de una mezcla entre investigación y reflexión sobre el lugar que tiene la memoria en el proceso iniciado por la Ley 975 de 2005 o de Justicia y Paz. El objetivo general del trabajo es evidenciar las contradicciones que, a raíz del diseño de la Ley, se dan en la práctica de la memoria en perjuicio de las víctimas y de la sociedad. Para ello, asumiré que se trata de un proceso de justicia transicional, aunque en diferentes sentidos y definiré el concepto de memoria del cual parto. En la segunda parte, describiré el lugar de la memoria en la Ley 975 de 2005, por medio de los procesos judiciales y de la labor del Grupo de Trabajo de Memoria Histórica, GTM H, de la Comisión Nacional de Reparación y Reconciliación, CNRR. Por último, analizaré el resultado práctico de la Ley en la única sentencia de justicia y paz: el caso de Mampuján.
dc.descriptionThe article is part of the doctoral thesis research. It is a mixture of research and reflection about the place of memory in the process initiated by the Act 975/2005 or “Justice and Peace.” The aim of this paper is to highlight the contradictions in the practice of memory, following the design of the Act, to the detriment of victims and society. To do this, it is assumed that Colombia is part of a transitional justice process but in different ways. Also we define the concept of memory which the analysis is developed. The second part will describe the place of memory in the Act 975/2005 through the judicial process and the work of historical memory group of the National Commission for Reparation and Reconciliation, CNRR . Finally, we will see the practical result of the law in the only ruling Justice and Peace sentence: The Case of Mampuján.
