The juridical structure of family law has never suffered such profound and permanent changes as it has done in present times, making it without a question one of the most dynamic branches of the international legal set of rules. Among the Latin juridical culture, it􏰒s in the Spanish State where more radical and evident civil legislation modifications have taken place, suggesting among other figures the acceptance of unilateral divorce with no cause and with no reflection term and same-sex marriages; these changes have no legal precedents in Europe and have been promulgated as the result of heated debates among conservative groups leaded by the Catholic Church, groups demanding a vindication of rights of constitutional equality as those of homosexuals, women associations and other groups and minorities, a situation that makes indispensable a reflection on debates already initiated in the XVIII Century and at the beginning of the XIX Century on the origin and nature of matrimony, in clarifying whether it is a State institution regulated by its rules or if on the contrary is subjected to the parties will.
