| dc.description | El derecho internacional del medio ambiente es un ordenamiento jurídico joven, caracterizado por la rapidez de su formación y por la multitud de normas e instituciones que lo componen. Su posición vanguardista frente a la teoría clásica del derecho internacional y del positivismo voluntarista le permite encontrarse en la mayoría de los debates de la actualidad. A lo largo de esta reflexión se pretenden analizar y poner de relieve las innovaciones del orden jurídico internacional medioambiental, determinando cómo su vitalidad y desarticulación, se convierten en componentes esenciales en la discusión acerca de su efectividad. | |
| dc.description | International environmental law is a young juridical order characterized by its fast configuration and by its multiple rules and institutions. Its vanguard position behind the classical theory of international law and the voluntarism positivism, allows it be in the middle of the most actual international law debates. This study pretends to analyze the innovations of this legal order by explaining how its vigour and disarticulation, generated by the legal and institutional profusion, are essential objects in the discussion of environmental law efficiency. | |
