dc.description	The Constitutional Court is the guardian and protector of the Colombian charter of fundamental rights, and in performing this obligation, it has undoubtedly played a progressive role by giving priority to the protection of social, economic and cultural rights. This task has involved constant confrontation with the other branches of government and some social sectors, who believe that it has played an excessively progressive role, outside the legal system, without addressing economic requirements, turning the law into the law of the judges. In examining this controversy, it is worthwhile to individually analyze certain positions taken by this entity with regard to specific rights and the type of argumentation that was used, and determine if they follow Hart’s tenets of judicial discretion or, conversely they consider Dworkin’s “Judge Hercules” analysis, or use both. In view of this, this article raises the following question: In 2011, what role did the Constitutional Court play with regard to protecting the territories of indigenous communities and ethnic cultural diversity?	en-US
dc.description	La Corte Constitucional es la guardiana y protectora de la carta fundamental de derechos y frente a esta obligación ha realizado un papel indudablemente progresista al darle prelación a la protección de los derechos económicos, sociales y culturales (DESC) frente a otros. En desarrollo de esta tarea han surgido constantes enfrentamientos con las demás ramas del poder público y algunos sectores sociales que consideran que ha ejercido un papel excesivamente progresista que rebasa el ordenamiento jurídico sin atender a los requerimientos económicos y convirtiendo de esta manera al derecho en el “derecho de los jueces”. En el contexto de esta controversia vale la pena analizar, entonces, algunas posiciones de esta corporación frente a derechos específicos así como el tipo de argumentación utilizado de manera singular, en el sentido de si atiende los postulados hartianos de discrecionalidad judicial; o por el contrario, concibe el análisis dworkiniano del juez Hércules o si se basa en ambos. Por lo anterior, se plantea el interrogante de cuál sería, entonces, el papel que ha realizado la Corte Constitucional en relación con la defensa del territorio de las comunidades indígenas y la protección de la diversidad étnico cultural en el 2011	es-ES
