dc.descriptionThis investigation of the Social Rule of Law from the comparative perspective between the Republic of Colombia and the Bolivarian Republic of Venezuela, is carried out through a theoretical review of its characteristics and fundamental elements (micro analysis), but above all it deepens them as to the jurisprudential revision uses the analogy as a method of reasoning, a fact that points out the aforementioned topic. Of course, it is clear that the scientific concern arises from the legal and political situation that happens in Venezuela, so resorting to comparative analysis with a neighboring country united by different ties of all kinds, makes sense; because they are republics with a common origin, they have a history developed in many aspects in unison as well as similar geographical, political, social and economic conditions. The most important thing is that when weighing the results, it will be possible to establish which path each legal code is taking on one of the most relevant topics and that occupies the largest space in Political Science and Law: Democracy. It can be affirmed that in Colombia there is a Rule of Law in force while in Venezuela the jurisprudential practice has surpassed this concept.en-US
dc.descriptionEsta investigación del Estado Social de Derecho desde la perspectiva comparada entre la República de Colombia y la República Bolivariana de Venezuela1, se lleva a cabo mediante una revisión teórica de sus características y elementos fundamentales (micro análisis), pero sobre todo los profundiza por cuanto en la revisión jurisprudencial se utiliza la analogía como método de razonamiento, hecho que puntualiza la temática mencionada. Por supuesto, es evidente que la inquietud científica surge de la situación jurídica y política que sucede en Venezuela, por ello recurrir al análisis comparado con un país vecino unido por diferentes lazos de toda índole, cobra sentido; porque son repúblicas con un origen común, tienen una historia desarrollada en muchos aspectos al unísono como también unas condiciones geográficas, políticas, sociales y económicas parecidas. Lo más relevante es que al sopesar los resultados podrá establecerse qué camino va tomando cada ordenamiento jurídico en uno de los tópicos más relevantes y que ocupa mayor espacio en la Ciencia Política y el Derecho: la democracia. Puede afirmarse que en Colombia hay un Estado de Derecho vigente mientras que en Venezuela la praxis jurisprudencial ha superado este concepto.es-ES
