dc.descriptionThe study of the objective imputation in the typicality of the conduct makes it unnecessary to carry out a new study of unlawfulness since its formal and material elements are criteria that will be analysed at the time of combining the legally permitted risk concerning the principle of harmfulness. Therefore, all the causes of the absence of responsibility must be studied within the typicality -typical unlawfulness - in the light of the integrating criteria of the objective imputation, since the legally underestimated risk from the point of view of the result determines the relationship about the objective and subjective assumptions of the criminal offense.en-US
dc.descriptionEl estudio de la Imputación Objetiva en la tipicidad de la conducta hace innecesario realizar un nuevo estudio de antijuridicidad, pues sus elementos formales y materiales son criterios que se analizarán al momento de conjugar el riesgo jurídicamente permitido en relación con el principio de lesividad. Como consecuencia, todas las causales de ausencia de responsabilidad deben ser estudiadas dentro de la tipicidad – antijuridicidad típica – a la luz de los criterios integradores de la imputación objetiva, toda vez que, el riesgo jurídicamente desvalorado desde el punto de vista del resultado determina la relación en lo que atañe a los presupuestos objetivos y subjetivos del tipo penal. Este planteamiento implica adicionalmente que los elementos que actualmente se consideran parte de la culpabilidad pasen a ser analizados en la tipicidad.es-ES
