dc.descriptionThis article responds to a review at a theoretical level, identifying the descriptive elements that support jurisdictional errors regarding criminal responsibility within the medical profession. It is devel­oped through the determination of representative elements of the criminal type, strengthening the analysis of some the cases of national connotation. The complexity and importance of medical liability processes today require investigative initiatives that provide informed responses to the many issues facing court decisions. The intention with which the action was carried out by the active subject of the conduct must be examined, adapting the action to the objective imputation.en-US
dc.descriptionEl presente artículo responde a una revisión teórica, donde se identifican diferentes elementos descriptivos que sustentan errores jurisdiccionales en torno a la Responsabilidad Penal dentro de la profesión médica. Se desarrolla a través de la determinación de elementos representativos del tipo penal, fortaleciendo el análisis de algunos de los casos de connotación nacional. “La complejidad y la importancia de los procesos de responsabilidad médica en la actualidad requieren iniciativas de inves­tigación que brinden respuestas informadas…” a los numerosos problemas que enfrentan las decisiones judiciales. Se debe examinar, en la conducta, la intensión con la que se realizó la acción por parte del sujeto activo, adecuándola a la Imputación Objetiva.  es-ES
