dc.description | In Colombia law studies are made with the certainty that law is a science and that that status is incontrovertible. Long time ago, the Cartesian concept of science was debunked and therefore that of juridical science based on the method of Descartes since the “principle of uncertainty” of Heisenberg deduced from the quantic theory and the relativity of the ontological truth, consequence of the theory of relativity of Einstein, tells us that it is the subject the one who previously determines how he wants and what he wants to know of the phenomenological universe and that the “truth” as an absolute given just once and forever does not exist, for it is the result of the measurements that the subjects makes within and from the space-time coordinates that it occupies. There is not a universal definition of what science is, that is impossible, since it is from the concepts of uncertainty and relativity that we need to broach the phenomena, this implies accepting that never will we know everything, so, How should we set a unique concept on this mutating world and knowledge? To know if law is a science depends on locating the range of phenomena that we call “juridical” in this new coordinates of human thought. | en-US |
dc.description | En Colombia los estudios de Derecho se hacen con la certeza de ser él una ciencia y que ese status es indisputable. Hace mucho tiempo se desbarató el concepto cartesiano de ciencia y por ende, el de ciencia jurídica basada en el método de Descartes, ya que el “principio de incertidumbre” de Heisenberg, deducido de la teoría cuántica y la relatividad de la verdad ontológica, consecuencia de la teoría de la relatividad de Einstein, nos dicen que es el sujeto el que previamente determina como quiere y que quiere conocer del universo fenoménico y que la “verdad” como un absoluto dada una sola vez y para siempre no existe, puesto que ella resulta de las mediciones que hace el sujeto dentro y a partir de las coordenadas espacio-- temporales que ocupe. No existe una definición universal de lo que es ciencia, ello es imposible, ya que como es a partir de la incertidumbre y la relatividad como debemos abordar los fenómenos, ello implica aceptar que jamás podremos saberlo todo, así ¿Cómo fijar en un concepto único lo mutable que resulta el mundo conocido y el conocimiento mismo? Saber si el Derecho es una ciencia depende entonces de ubicar el haz de fenómenos que solemos llamar “Jurídicos” en estas nuevas coordenadas del pensamiento humano. | es-ES |
