dc.descriptionThis study briefly exposes the road traveled by The European Union’s treaties, institutions and the battle towards the creation of a positive catalog of human rights and fundamental freedoms. As a result, the European Union Treaty’s legal referral to the Charter of Fundamental Rights elevates its status to substantive right. This significant event together with the imminent accession to the European Agreement for the defense of the human rights and fundamental freedoms has suggested the start of a new political integration cycle that leads its steps to reach the goals which have been called “Constitutional Community” by some authors.en-US
dc.descriptionEl presente trabajo expone brevemente el camino recorrido por los Tratados de la Unión Europea, sus Instituciones y la pugna por la creación de un catálogo positivado de derechos humanos y libertades fundamentales, fruto de ello, la remisión jurídica del Tratado de la Unión Europea a la Carta de los Derechos Fundamentales eleva su estatus a derecho primario. Este significativo acontecimiento, junto a la inminente adhesión al Convenio Europeo para la protección de los derechos humanos y las libertades fundamentales, ha supuesto el inicio de un nuevo periodo de integración política que dirige sus pasos hacia la consecución de los objetivos que algunos autores han denominado “comunidad Constitucional” .es-ES
