dc.descriptionA series of reflections and approaches are presented in this chapter, with which it is intended to introduce the reader to an oceanic theme, that is, the respect and guarantee with a differential approach, of the rights and duties of people in Colombia with special protection. constitutional, within the framework of the construction of peace that Colombian society longs for; committed for which, as a conceptualization, contextualization and characterization, a first section is an approximation to the supra-legal foundations of equality in the Constitutional, Social and Democratic State of Colombian Law; secondly, the respect and guarantee from the point of view of the differential approach is analyzed, taking into account the typology that normative, jurisprudential and doctrinally has been proposed in relation to these collectives; to culminate in a third part, with some recommendations for inclusion from the recognition of the difference, as a budget for guaranteeing and respecting the rights of the subjects of special constitutional protection, in the implementation of the following agreements derived from the process of peace.en-US
dc.descriptionSe dan a conocer en éste capítulo una serie de reflexiones y planteamientos, con los que se pretende adentrar al lector en una temática oceánica, esto es el respeto y garantía con enfoque diferencial, de los derechos y deberes de las personas en Colombia con especial protección constitucional, en el marco de la construcción de paz que anhela la sociedad colombiana; cometido para el cual, a manera de conceptualización, contextualización y caracterización, se realiza en un primer apartado una aproximación a los fundamentos supra legales de la igualdad en el Estado Constitucional, Social y Democrático de Derecho colombiano; en segundo término, se analiza el respeto y garantía desde la óptica del enfoque diferencial, atendiendo a la tipología que normativa, jurisprudencial y doctrinalmente se ha venido planteando en relación con estos colectivos; para culminar en una tercera parte, con algunas recomendaciones para la inclusión desde el reconocimiento de la diferencia, en tanto presupuesto para que se garanticen y respeten los derechos de los sujetos de especial protección constitucional, en la implementación de los pos acuerdos derivados del proceso de paz.es-ES
