dc.descriptionOne of the main problems that currently arise and that affects workers in a notorious way is the fraud to the law and the simulation in labor matters with the use of the figure of the outsourcing and other contractual modalities for the hiring of personnel such as the contract for the provision of services. This is fraud in the law and simulation because, despite the fact that compliance with the elements that make up an employment contract is notorious, there is a tendency to use the contract for the provision of services to evade the obligations that fall on employers when they conclude an employment contract and an employment relationship comes into being.en-US
dc.descriptionUna de las principales problemáticas que se presentan en la actualidad y que afecta de manera notoria a los trabajadores, es el fraude a la ley y la simulación en materia laboral con el empleo de la figura de la tercerización y de otras modalidades contractuales para la contratación de personal como el contrato de prestación de servicios. Se trata de fraude en la ley y simulación porque a pesar de ser notorio el cumplimiento de los elementos que constituyen un contrato de trabajo, se tiende a emplear el contrato de prestación de servicios para evadir las obligaciones que recaen sobre los empleadores a la hora de celebrar un contrato de trabajo y nacer a la vida jurídica una relación laboral.es-ES
