dc.descriptionColombia has been a country in constant struggles to protect and care for the property that belongs to the Country, so this article asked about the judgement of the Supreme Court of Justice -Civil Cassation Chamber-, uttered on July 5, 2007, where the appeals are determined, in respect of the judgement of March 7, 1997, uttered by the Superior Court of Barranquilla (Civil-family room), in the ordinary process, promoted by the company Sea Search Armada against the Colombian nation and the intervention of the Procurator General of the Nation; being this way, the paper begins with the historical context of the Galleon San José, using legal considerations, where is discussed whether it is a treasure and whether or not it belongs to the Colombian nation; In the same way, an analysis is made corresponding to the general and normative characteristics on the treasury, the cultural, historical, artistic, archaeological heritage and in turn, it delves into the relevant facts subsequently arising in relation to the ruling dictated.en-US
dc.descriptionColombia ha sido un país visto en constantes luchas por proteger y cuidar los bienes que le pertenecen, es así, que este artículo cuestiona la sentencia de la Corte Suprema de Justicia Sala de Casación Civil, proferida el 5 de julio de 2007, en donde se determinan los recursos de casación interpuestos, respecto de la sentencia del 7 de marzo de 1997, proferida por el Tribunal Superior de Barranquilla (Sala Civil-Familia), en el proceso ordinario, promovido por la sociedad Sea Search Armada contra la Nación Colombiana y la intervención de la Procuraduría General de la Nación; siendo así esto, se inicia con el contexto histórico del Galeón San José, recurriendo a consideraciones legales, en donde se discute si es este un tesoro y si se pertenece o no a la Nación Colombiana; de igual forma, se hace un análisis correspondiente a las características generales y normativas sobre el tesoro, el patrimonio cultural, histórico, artístico, arqueológico y a su vez, se profundiza en los hechos relevantes surgidos posteriormente en relación con el fallo dictado.es-ES
