dc.description	Be the first to point out that the basic problems of the general theory of crime in light of the criminal law dogmatics and the criminal law system, are multiple, attending to the various intellectual legal positions that arise in the academic, legislative and judicial world , and of course against the reality of human behavior. In addition to the above, I have always felt that regardless of the legal positions of the great thinkers of criminal law, the human being must always take precedence over the criminal law, ultimately the creator of the criminal law and legal-criminal concepts is man. to apply it to man, therefore, criminal law cannot unfairly oppress the human person, although it is fundamental as an instrument of social control, we believe that there is an excess of objective criminal law and punitive law in particular, which allows duty rulers clear approaches to authoritarianism and legal despotism. Notwithstanding the foregoing, we have selected some of the problems that have caused the greatest concern in our professional and teaching activity, within the great universe of problems that may exist. Thus: Guarantor position - Improper Omission, Criminal law of the enemy in the punishability of preparatory acts and Equivocity between the eventual intent and Guilt with representation.	en-US
dc.description	Sea lo primero señalar que los problemas básicos de la teoría general del delito a la luz de la Dogmática jurídico penal y el sistema del derecho penal, son múltiples, atendiendo a las diversas posiciones jurídicas intelectuales que se plantean en el mundo académico, legislativo y judicial, y por supuesto frente a la realidad del comportamiento humano.   Además de lo anterior siempre he sentido que independientemente de las posiciones jurídicas de los grandes pensadores del derecho penal, siempre deberá primar el ser humano sobre la norma penal, en últimas el creador de la norma penal y de los conceptos jurídico-penales es el hombre para aplicársela al hombre, por lo tanto la ley penal no puede oprimir injustamente a la persona humana, si bien es fundamental como instrumento de control social, creemos que existe un exceso de derecho penal objetivo y de derecho punitivo en especial, que permite a los gobernantes de turno claras aproximaciones al autoritarismo y despotismo legal. No obstante lo anterior, hemos seleccionado algunos de los problemas que mayor inquietud han despertado en nuestro trasegar profesional y docente, dentro del gran universo de problemas que pueden existir. Así: Posición de garante - Omisión Impropia, Derecho penal del enemigo en la punibilidad de los actos preparatorios y Equivocidad entre el Dolo eventual y Culpa con representación.	es-ES
