| dc.description | Problema, En la distribucion de la herencia, los hijos de la familia constituida por hecho o mediante el vinculo del matrimonio, se enfrentan con los hijos de crianza que han sido cuidados custodiados vigilados atendidos por sus padres. Los bienes herenciales e incluso los activos intangibles y otros que representan un valor economico se convierten en un motivo de enfrentamientos. Objetivo, Analizar la figura del Hijo de crianza en el ordenamiento juridico colombiano. Metodologia, Tipo de investigacion Basica Juridica que se apoya en Jurisprudencias de las altas Cortes; se utiliza el metodo deductivo que parte de la conceptualizacion de los hijos de crianza en las jurisprudencias hasta Ilegar a un metodo inductivo que determina las diferencias entre el Prohijamiento de crianza y la adopcion, el padre o madre de crianza; Resultados, La Familia de Crianza surge cuando un menor ha sido separado de su familia biologica y cuidado por otra familia, durante un lapso considerable, que ha permitido desarrollar vinculos afectivos reciprocos, de tal magnitud que separarlos implicaria afectar la estabilidad psicologica y emocional del menor"; Conclusion, El Codigo Civil establece tres formas de parentesco, la primera es por consanguinidad, civil y por afinidad. Podria entonces decir que el hijo de crianza se vincula a la familia por afinidad al grupo familiar constituido, que se integra en el sentir de los miembros de la familia con respeto, afecto y solidaridad, identificandose como otro miembro mas como sucede con los hijos adoptados. | es-ES |
