dc.descriptionProblem, the nail tearing the social fabric imposed a male role and the man who abandons his pregnant partner although the law stipulates that the Food and care for the pregnant mother is an obligation for the man who generates a pregnancy, and this must answer for this action, the rights of pregnant women and the unborn child. Objective, determine the rights of the unborn child care food and the pregnant mother and the constitutional and legal system of the nation. Methodology Research type Basic Law, deductive theoretical approach that explores the rights of the pregnant mother and the unborn child, sexual and reproductive responsibilities of the couple, food and care owed grant, effects and legal implications and legal trucking for male abandonment by her partner in gestation. Results, the preamble and Articles 2 and 5 of the Constitution enshrine "It is the duty of public authorities to ensure the right to life of" all people ", and obviously the protection covers the protection of life during the process of formation and development, being a condition for the viability of birth, which gives rise to the legal existence of the people. Conclusions The pregnant woman has special rights and prevalent in her motherhood. The law protects the unborn child in her pregnancy, when it was conceived because the Constitutional Court will recognize the same rights as anyone, especially their state of helplessness in which is located.  en-US
dc.descriptionProblema,  el desquebrajamiento del tejido social impuso un rol de macho al varón que embaraza y abandona a su pareja aunque la ley consagra que los Alimentos y cuidados para la madre gestante es una obligación para el varón que genera un embarazo, y este deberá responder por esta acción, por los derechos de la mujer gestante y por la vida del Nasciturus. Objetivo, Determinar los derechos de alimentos y cuidados del Nasciturus y de la madre gestante en el ordenamiento constitucional y jurídico de la nación. Metodología, Tipo de investigación Básica Jurídica, método teórico deductivo que indaga por los derechos de la madre gestante y del Nasciturus, las responsabilidades sexuales y reproductivas de la pareja, los alimentos y cuidados que se le deben otorgar, los efectos e implicaciones legales y jurídicas que acarrean para el varón por el abandono de su pareja en estado de gestación.  Resultados, el preámbulo y los artículos 2° y 5° de la Constitución Política consagran: “es deber de las autoridades públicas, asegurar el derecho a la vida de "todas las personas", y obviamente el amparo comprende la protección de la vida durante su proceso de formación y desarrollo, por ser condición para la viabilidad del nacimiento, que da origen a la existencia legal de las personas. Conclusiones, La mujer embarazada tiene derechos especiales y prevalentes en su maternidad. La Ley protege al Nasciturus en su estado de embarazo, al ser que fue engendrado, porque a este la Corte Constitucional le reconoció los mismos derechos que cualquier persona, sobre todo por su estado de indefensión en el que se encuentra.  es-ES
