dc.description | Harmonization processes on private law, and specially credit and Standby letters, generate an interesting field of reflection about State’s role in front of other actors who have been increasing their prominence. About international regime of Standby letters, there are two tendencies: One of interstatecharacter, headed by the United Nations through UNCITRAL, and the other of private character, where the work of the International Chamber of Commerce and Institute of Right and International Banking Practices is outstanding. This essay analyzes the situation and concludes that exist some areas of the private international law, where is major efficacy in the international harmonization by determined private actors in front of the intergovernmental agencies such as the United Nations. | en-US |
dc.description | Los procesos de armonización internacional del derecho privado, y en especial de las cartas de crédito y cartas Standby, generan un interesante campo de reflexión acerca del papel del Estado frente a otros actores que han venido incrementando su protagonismo. Sobre el régimen internacional de las cartas Standby, existen dos tendencias: una de carácter interestatal, liderada por las Naciones Unidas a través de la CNUDMI,y otra de carácter privado, donde se destaca la labor de la Cámara de Comercio Internacional y el Instituto de Derecho y Prácticas Bancarias Internacionales. Este ensayo analiza la situación y concluye que existen áreas del derecho internacional privado donde hay mayor eficacia en la armonización internacional por parte de determinados actores privados sobre los organismos intergubernamentales, tales como las Naciones Unidas. | es-ES |
