dc.descriptionThe one that uses the force to oblige another to make a crime should act with direct dolus with relationship to the action of force. It should in fact direct its coercion action to the obtaining that the third performs the fact described by the penal type; if it has not been in this way, although the one who employed the force has thought that the used force could –as possibility- to have that effect in the third, it cannot be described as author as what in definitive this third executed. It is mediate author only the person that concretely directed its activity of force to the objective that another person should carry out a certain crime. In turn, it is not inconvenient so that the mediate author responds, to title of eventual deceit, of that carried out by the one coerced, with relationship to the possible deviations or alterations that it suffers in the event during his concretion for this last one.en-US
dc.descriptionEl que usa la fuerza para obligar a otro a cometer un delito debe actuar con dolo directo con relación a la acción de fuerza. Debe dirigir su acción de coacción precisamente a la obtención de que el tercero realice el hecho descrito por el tipo penal; si no ha sido así, aunque haya pensado el que empleó la fuerza que la misma podría - como posibilidad- tener ese efecto en el tercero, no puede ser calificado como autor de lo que en definitiva este tercero ejecutó. Es autor mediato únicamente aquél que concretamente dirigió su actividad de fuerza al objetivo de que otra persona realizara un determinado delito. A su vez, no se ve inconveniente para que el autor mediato responda, a título de dolo eventual, de lo realizado por el coaccionado, con relación a las posibles desviaciones o alteraciones que sufra en el evento durante su concreción por este último.es-ES
