dc.description | Trade through technology, more precisely the internet, is an activity that has been showing an exponential growth during the last years, which is completely different to the traditional trade, since physical contact is not needed, nor is there a problem by geographical location. At the international level, the states whose economy shows signs of development, a regulation has been presented to this phenomenon, not only at the level of the buyer / seller relationship, but also in the fiscal scope of these transactions. Currently, our country has legislation that regulates the transactions carried out by this means, but is the structure of this legislation really adapted to the nature of this phenomenon? Therefore, it is necessary to analyze the existing regulation in Colombia, not only in the commercial sphere, but in essence to identify the fiscal treatment given to these operations. Deepening the Colombian legislation, despite having an effective control of the transactions made through electronic commerce, its tax treatment lacks a special statute, therefore its treatment is equal to that of traditional commerce, a situation that is contrary to the laws in countries such as the United States and the United Kingdom where it is fully identified that this type of transactions are different from those of traditional commerce, therefore, taking into account the economic evolution that the country has been presenting, a pronouncement by the legislator is necessary in order to set clear differences, in fiscal aspects, between this type of transactions to those of traditional commerce. | en-US |
dc.description | El comercio desarrollado a través de los instrumentos que ofrece la tecnología, más exactamente el internet, es una actividad que ha venido presentando un crecimiento exponencial durante los últimos años, cuya esencia, es completamente diferente al comercio tradicional, ya que no se hace obligatorio un contacto físico, ni existe problema por ubicación geográfica. A nivel internacional los estados cuya economía muestra signos de desarrollo, se ha presentado una reglamentación a este fenómeno, no solo a nivel de relación entre comprador/vendedor, sino también en el ámbito fiscal de esas transacciones, actualmente nuestro país cuenta con una legislación que regula las negociaciones realizadas por este medio, pero ¿realmente está adaptada la estructura de esta legislación a la naturaleza deeste fenómeno? Por lo tanto, se hace necesario analizar cuál es la normatividad que existe en Colombia, no solo en el ámbito comercial, sino en esencia identificar el tratamiento fiscal que se le da a estas operaciones. Profundizando la legislación colombiana, a pesar de contar con un efectivo control de las transacciones realizadas mediante comercio electrónico, su tratamiento fiscal carece de un estatuto especial, por lo tanto su tratamiento es igual al del comercio tradicional, situación que es contraria a las legislaciones de países como Estados Unidos y Reino Unido en donde se identifica plenamente que este tipo de transacciones son diferentes a las del comercio tradicional, por lo tanto, teniendo en cuenta la evolución en el carácter económico que ha venido presentando el país, es necesario un pronunciamiento por parte del legislador en que se planteen unas diferencias en aspectos fiscales, este tipo de transacciones a las del comercio tradicional. | es-ES |
