Mitos y realidades sobre la Ley general forestal (Ley 1021 del 20 de Abril de 2006)

Abstract

Las acciones legislativas son instrumentos fundamentales para el apalancamiento y la generación de condiciones que permitan el abordaje de temas generales, no obstante no son la política ni la acción para el emprendimiento del desarrollo alrededor del tema que abordan. Para el caso de la Ley 1021 o Ley General Forestal promulgada el 20 de abril de 2006, no se le debe exigir menos de lo que debe contener al ser una Ley marco sectorial, ni más de lo que puede dar por no ser más que una herramienta para la implementación de política. No existen seres humanos perfectos y por ende no hay leyes perfectas, así que debe desarrollarse una lectura objetiva y rigurosa del alcance, limitaciones e implicaciones de su puesta en vigor, sin desconocer la prolifera legislación previa desarrollada alrededor del tema. El presente artículo hace una reflexión sobre los comentarios que se ciernen sobre esta ley y la realidad y oportunidad de los mismos a la luz de la legislación y jurisprudencia previa existente.

The present atticle makes a reflection on the commentaries that hung over this law and the reality and opportunity of such to the light of the legislation and existing previous jurisprudence.
